Item 03: Rezoning 22.58 Acres at Wonder World & Highway 123 Intersection

Consider approval of Ordinance 2021-77, on the second of two readings, amending the Official Zoning Map of the City in Case No. ZC-21-16 by rezoning approximately 22.58 acres of land, generally located at the Northwest Corner of the Wonder World Drive and Highway 123 Intersection, from “FD” Future Development District to “EC” Employment Center District, or subject to consent of the owner, another less intense zoning district classification; including procedural provisions; and providing an effective date.

Covenant 1. I'm not sure that "The Parties also agree that a hotel/motel, as defined in section 5.1.5.6 of the San Marcos Development Code (2018), will not be constructed on any part of the property within 200 feet of the property line shared with the senior center and church located on the western side of the 22.58-acre tract legally defined as Mockingbird Hills Annex No. One Revised and Lot 1 Block “A” of Mockingbird Hill Annex No. Two, as set out in Exhibit “A” attached." is exactly our request. We wanted to ensure that the hotel would be on Hwy 123, just as it was on the map we saw. Locating it 201 feet from the senior center and church won't work for me. Also it's a Senior LIVING Center. Not an activity center. And where is the bus stop?

The language in the restrictions was provided by the applicant – we can work with the applicant on a different measurement for the hotel. Example: hotel use shall only be permitted within XX feet from SH 123. Council would need to provide this direction during the meeting. See attached exhibit re 200’ measurement. The senior center can be reworded to say senior living facility. The bus stop is not yet shown on their plans.
