Consider approval of Ordinance 2022-36, on the second of two reading, amending the Official Zoning Map of the City in Case No. ZC-22-11, by rezoning approximately 64.78 acres of land located at the 1800 block of Clovis Barker Road from “FD” Future Development District to “LI” Light Industrial District, or, subject to consent of the owner, another less intense zoning district classification, including procedural provisions; providing an effective date

Since we requested the Restrictive Covenant, and it is in the packet, shouldn't the Ordinance include that fact? The Ordinance is what is filed and available to the public. Leaving out this important item of information seems like a not-so-good idea.
Have we included it in the ordinance before?
If so, we should again.
If not, we should start.
Please prepare amendment language for the ordinance and I'll make the motion to amend.
Add Recital number 6?

The way we have been doing these is to make the ordinance effective upon the recording of restrictive covenants. This is what the current draft ordinance in the packet states:
SECTION 4. This ordinance will take effect after its passage, approval and adoption on second reading and the recording of a duly executed restrictive covenant agreement in substantially the form in Exhibit B, attached hereto and made a part hereof, prohibiting certain waste-related services on the Property as outlined in Exhibit B.
Based on the wording above, I don’t believe there is a need to amend the ordinance.
