Item 05: San Marcos City Code- Restrictions on Beverage Containers & Coolers

Consider approval of Ordinance 2024-08, on the second of two readings, amending Chapter 58, Public Facilities, Parks and Recreation of the San Marcos City Code to add restrictions on certain beverage containers and coolers in the San Marcos River and within designated park areas adjacent to the river; providing penalties for violations of such restrictions; providing a savings clause; providing for the repeal of any conflicting provisions; and providing an effective date.

Thanks for the updates to the ordinance (blue) included as a result of council discussion/action at the first reading.

There is one more that we discussed. Sec 58.073 a
(a) It shall be unlawful for anyone to use, carry, possess, or dispose of
CHANGE TO
(a) It shall be unlawful for any one person to use, carry, possess, or dispose of
This is to make it fully clear the limitation on coolers includes one per person.
