Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2023-32, annexing into the City approximately 619.755 +/- acres of land out of the William Pettus Survey, Abstract No. 21 and the Thomas Maxwell Survey No.17, Abstract No. 188, Caldwell County, Texas, generally located northwest of the intersection between FM 110 and SH 80; between FM 110, SH 80, and FM 1984; approximately 4,000 feet northeast of the intersection between SH 80 and Quail Run Road, and between SH 142 and Valley Way Drive Case No. AN-22-20 SMART Terminal; including procedural provisions; and providing an effective date; and consider approval of Ordinance 2023-32, on the first of two readings.

Do we have a map of the water CCNs overlaid on the SMART Terminal map - all acres covered by the Development Agreement? If so, please provide.

On the Existing Level of Service for Transportation (page 469) it shows F for SH 80/SH 110. SH 110 hasn't been built yet alongside SMART Terminal and I am having a hard time believing the "middle" section of SH 110 is an F.
Why is Hwy 142 at level D? I don't drive it often but I've never seen it anywhere near a D level.

Regarding wastewater, please advise if our wastewater plant is built to handle whatever may come from the allowed uses? I know we have other industrial customers in our city.

After a very heavy rainstorm a few months ago (Dec 2022?) someone has told me that construction on FM110 showed what would be the roadway underwater and that the construction crews raised the pavement level. Is this accurate?

Regarding archeological sites, what will be required?

Regarding Fire Service. Will the development of the SMART terminal adversely affect the insurance rates for people in San Marcos? I've read the FAQ section on Fire Service / ISO Rating and I don't find this info there because it addresses a "sufficient ISO rating" without specification.

Do we have the FAQ in Word format (or can we get it)? This print appears to be 9 point type and that's a bit small.

What about the concerns regarding depth of cut and fill and the water table?

Please provide color versions of the maps pages 645-646, part of the minor changes to the Development Agreement.

Is it possible to include limitations to truck traffic at busy I35 locations on Highway 80 and 123?

New Fire Station cost, along with donating the land could the developer help with the building cost of a new station?

Could the developer participate or partner with local environmental/river organizations to help facilitate a culture of environmental protection?

Is it possible to include limitations to truck traffic at busy I35 locations on Highway 80 and 123?
Public streets are accessible to all of the public unless specific truck restrictions are in place, however these roads are owned and maintained by TxDOT. The development agreement includes language that requires truck route signs to encourage trucks away from busy intersections.

New Fire Station cost, along with donating the land could the developer help with the building cost of a new station?
The developer was asked this question during development agreement negotiations and did not agree to construction costs.
Could the developer participate or partner with local environmental/river organizations to help facilitate a culture of environmental protection?
This question has been forwarded to the developer, staff will ask they address this in their presentation.

FM 110- is not on the “Existing” maps – the LOS-F only reflects SH 80 in the vicinity of FM 110

The model likely projected a lot of San Marcos to Lockhart traffic on a 2-lane road.

The City Wastewater Treatment Plant is able to handle the wastewater flows that follow Chapter 86 – Utilities of the City’s Code of Ordinances. Article 3, Division 2 specifically addresses Industrial Waste Discharge Regulations including prohibited discharges and the requirement for pretreatment facilities.

Regarding archeological sites, what will be required? The development is required to provide a statement of no impact by a qualified environmental professional or approval from state and federal agencies for impacts to endangered species or habitat, archeological sites, historical structures, wetlands and/or waters of the US, and contaminated soils and hazardous spills.

What about the concerns regarding depth of cut and fill and the water table? Water tables at different depths are handled in various ways by development. The requested cut and fill will be part of the mitigation of those conditions.
