Consider approval of Resolution 2021-179R, approving an agreement that grants a Non-Exclusive License to Skinny Labs, Inc., doing business as SPIN, that enables SPIN’S shared micromobility devices such as electric scooters and electric bicycles to be operated within City rights-of-way; and declaring an effective date.

From the resident’s perspective, the transition from the Pilot Agreement to the License Agreement will be seamless and uninterrupted. There are positive outcomes for the residents to include the addition of a dockless bicycle fleet.
The License Agreement offers the following terms:
  • The License Agreement is “non-exclusive” meaning at Council’s discretion other companies could be allowed to operate in the City. The Pilot Agreement was “exclusive”
  • The initial License Agreement term runs until June 2022 with the option to renew for five (5) additional one year terms.
  • The License Agreement allows for the operation of motor-assisted scooters and electric pedal assist bicycles. The Pilot Agreement was for motor-assisted scooters only
  • The License Agreement includes a 20 cents per ride revenue share to the City, for rides beginning in the City. The Pilot Agreement provided a lump sum of $10,000 and a revenue share of 2.5%
    • Spin also offers a marketing revenue share if the City allows Spin “charging hubs” in the City with Liquid-Crystal Display (LCD) advertising screens at roughly 30% net profit (Staff will assess feasibility as relates to the Land Development Code)
  • The License Agreement includes a “penalties” table which would allow the City to compel remedial action for non-compliance with the Agreement by company. The Pilot Agreement did not include a “penalties” table
