Consider approval of Resolution 2022-225R, amending the contract prosecutor agreement with Douglas G. Montgomery for professional legal services in the San Marcos Municipal Court of Record to increase the fee for such services from $70.00 to $80.00 per hour; authorizing the city attorney to execute the agreement; and declaring an effective date.

How many hours per year does he work for us?
FY 21-22: 497 Hours
FY 20-21: 505 Hours

How much increase to the budget will this create?
It is anticipated this hourly rate increase will have little, if any, impact on the overall budget for Legal Services. The annual amounts billed for Mr. Montgomery’s services for the past three fiscal years have ranged between $35,000 and $45,000. Any additional increase above those amounts in FY 2022-2023 can be absorbed within the budget by savings in other expenses and/or vacancy savings.
