Consider approval of Resolution 2023-182R, approving amendment number one to the Memorandum of Understanding with Don Jackson Construction, Inc., related to the development of the Kilo Development area at the San Marcos Regional Airport for the purpose of extending the term of such agreement; authorizing the City Manager, or her designee, to execute the amendment on behalf of the city; and declaring an effective date.

DJC is currently negotiating with a tenant to build on the remaining area but the ground lease has not been finalized. They have a pre-development meeting scheduled the end of this month and we anticipate a ground lease to be finalized before the first of the year. This extension allows DJC to continue to negotiate without the City losing any revenue associated with the MOU.
