Consider approval of Resolution 2022-40R, authorizing a Change in Service to the agreement with Garver LLC relating to the Airport Master Plan Project to add consultation services related to the airport zoning project in the amount of $62,964.00; authorizing the City Manager or her designee to execute the appropriate documents to implement the Change in Service on behalf of the City; and declaring an effective date.

We discovered that the company that did the master plan did a bad job of capturing who the stakeholders in attendance were and I do not believe residents were reached out to adequately. Can we require them to gather demographics and stakeholder status at their meetings (ie. resident, landlord, business oriented)?

Also, a lot of the "extra work" seems like it would serve the interest of what we're paying for; how are they going to adequately recommend a zoning ordinance while neglecting to -
o Survey work.
o Property ownership research/review.
o Legal review of Airport Zoning Ordinance and other associated deliverables.
o Drafting airport zoning regulations for municipalities other than the City of San Marcos (doesn't the airport span two counties?)
o Environmental analysis, research, or review.
o Coordination with other municipalities outside of the specific coordination identified in the scope of services. (doesn't the airport span two counties?)

We will ensure all appropriate communication efforts are used to promote public input events. Stakeholders will be asked to volunteer this information during public outreach activities. Staff will also work on targeted community outreach. Likewise with the other participating jurisdictions. I’m not sure if the city or a consultant can require individuals, who attend public meetings, to disclose their information. I expect it can only be offered voluntarily.

The consultant is making clear with these items what is not covered by the main scope of work. However, the main scope covers what’s needed to develop the zoning regulations. Additional comments below.

o Survey work.- this refers to specific survey work such as by a registered land surveyor to identifying property boundaries, for example. Typically this is not needed to develop zoning regulations.
o Property ownership research/review.
If needed, County Appraisal District records should suffice and the city can gather this information.
o Legal review of Airport Zoning Ordinance and other associated deliverables. The consultant is primarily a planning and engineering firm and does not provide legal services. The city will undertake legal reviews as needed.
o Drafting airport zoning regulations for municipalities other than the City of San Marcos (doesn't the airport span two counties?).
The scope of work includes coordination with Hays and Caldwell County who will be part of a Stakeholder Committee. Hence, we will be working closely with them and our intention is that they will write the regulations to incorporate into their ordinances. The Airport Zoning Act does require other jurisdictions to adopt the regulations.
o Environmental analysis, research, or review.
Typically this is not required to develop zoning regulations. Similarly not required for the city zoning development.
o Coordination with other municipalities outside of the specific coordination identified in the scope of services. (doesn't the airport span two counties?) This is for coordination with entities beyond those already named in the scope. Which are Hays and Caldwell County and City of Martindale.
