Consider approval of Resolution 2023-92R, approving a renewal for a term of one year of the License Agreement with Skinny Labs, Inc., doing business as SPIN, that enables SPIN’s shared micro-mobility devices such as electric scooters to be operated within city rights-of-way; authorizing the City Manager, or her designee, to execute said renewal on behalf of the City; and declaring an effective date.

Agenda item states " shared micro-mobility devices such as electric scooters" - what other micro-mobility devices might there be in the future?
"Section 2, Grant of License this is for SMDs - Shared Mobility Devices."
If they choose to bring a different type of device, whether in addition to the current scooters or replacing the current scooters what is required in the way of notification to us? I didn't see it in the contract.

The industry does evolve with new micro-mobility devices. Please see the picture of a “seated” electric scooter below as an example. Staff will monitor these emerging shared micro-mobility devices to optimize for San Marcos.

If they choose to bring a different type of device, whether in addition to the current scooters or replacing the current scooters what is required in the way of notification to us? I didn't see it in the contract. Per license agreement SPIN is required to submit a written request to the city for any change to the scooter fleet, including a change to the device type/model or a change in fleet inventory number. Staff would need to approve the change in writing. Any substantive change to scooter type/model would come back to City Council (with staff recommendation) for consideration.
