Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2021-93, amending the Official Zoning Map of the City in Case No. ZC-21-17 by rezoning approximately 2.78 acres of land, generally located in the 5900 Block of South IH-35, from “FD” Future Development District and “AR” Agricultural Ranch District to “HC” Heavy Commercial District, or, subject to consent of the owner, another less intense zoning district classification, and including procedural provisions; and providing an effective date and consider approval of Ordinance 2021-93, on the first of two readings.

The PZC unanimously recommended an alternative zoning district CM which requires a CUP for a gas station.
Staff is still recommending HC.
Why not the solution PZC offers?
Was CM with CUP discussed with the applicant?

Will there be a new application fee IF council recommends CM instead?
And how do we formally request waiving the CUP fee, IF council goes in the same direction as the PZC AND IF we want to do that?

Staff is still recommending HC. Staff recommended approval of the original request for HC
Why not the solution PZC offers? Since staff supported the original request, we can support a lesser zoning district if Council choses to approve it
Was CM with CUP discussed with the applicant? Yes, they are willing to go through the process

Will there be a new application fee IF council recommends CM instead? No, the zoning change fee paid for HC will cover whatever Council approves.
