Consider approval of Resolution 2023-93R, approving an Advance Funding Agreement with the State of Texas, acting through the Texas Department of Transportation (“TXDOT”), for the construction of the Highway Safety Improvement Program Grant Improvements for the roadway resurfacing of Sessom Drive from Alamo Street to University Drive (“Loop 82”) with an estimated city participation amount of $116,290.00 plus 100 percent of any cost overruns; authorizing the City Manager, or her designee, to execute said agreement on behalf of the City; and declaring an effective date.

Is there a limit to the amount of cost overruns for which the City is responsible?

There is no limit to the amount of cost overruns for which the City is responsible. Asphalt paving cost overruns are primarily attributed to fluctuations in oil prices. Based on government projections, long-term oil prices are not expected to fluctuate wildly. Nonetheless, this TxDOT grant will save the City $678,691 of street operating funds. Any cost overruns due to fluctuations in oil prices can be covered by these savings.


Is the City responsible for this project or TxDOT? (Choosing contractor, oversight of project, etc.)
The City is responsible for the in-house design of the project. TxDOT is responsible for bidding, awarding (choosing the contractor), administering the contract, and overseeing construction management of the project.


Document to be signed has "interim" for the city manager.
The Advance Funding Agreement is a draft. The final agreement will correct the City Manager title and include the signed resolution.
