Receive a staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2022-13, amending the Official Zoning Map of the City in Case ZC-21-27, by rezoning approximately 0.294 acres of land, being Lot 46 of the A.M Ramsay Subdivision, located at 101-103 Lockhart Street from “D” Duplex District to “ND-3” Neighborhood Density-3 District, or, subject to the consent of the owner, another less intense zoning district classification, including procedural provisions; and providing an effective date, and consider approval of Ordinance 2022-13 on the first of two readings.

I know that D-duplex doesn't have occupancy restrictions but two sides of the property is SF which does.
Was the zoning district ND 3.5, which does have occupancy restrictions, proposed to the applicant? Was it considered?

Would this be the only two-story house in the neighborhood?

Both ND-3.5 and ND-3 were discussed during the pre-development meeting process however ND-3 was deemed sufficient to meet the density requirement of their proposal. ND-3 also includes occupancy restrictions.

Would this be the only two-story house in the neighborhood? No, there are at least 2 two-story homes within the 400 ft. buffer (approximate addresses: 110 Third St. and 319 Mill St.). There are also multistory apartments in the area (Village Green Apartments & Bobcat Village Apartments).
