Consider approval of Ordinance 2022-06, granting the consent of the City of San Marcos, Texas, to the creation of Hays County Municipal Utility District No. 9 and the inclusion therein of approximately 475.393 acres of land located within the City’s Extraterritorial Jurisdiciton in the vicinity of Old Bastrop Highway between Redwood Road and the San Marcos River; approving an associated consent agreement with HK Riley’s Pointe, LLC and Benchmark Acquisitions, LLC; authorizing the City Manager, or the City Manager’s designee, to execute the consent agreement; providing procedural provisions; providing for the adoption of this Ordinance on only one reading and providing for an effective date.

Is this MUD document, with the exception of the location and a few specifics to the location, basically the same as the one with HK Baugh (#20)?

Yes. The two are basically the same. The main differences between the two Utility Agreements and Consent Agreements is that MUD#9 is served by the City for both Water and Wastewater while MUD#8 is wastewater only but includes language around the City providing water service if Crystal Clear does not. Otherwise, there are no substantial differences between the two.
