Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2022-78, amending the Official Zoning Map of the City in Case No. ZC-22-33, by rezoning approximately 120 acres of land, generally located near the 4100 block of State Highway 21, approximately 1,400 feet north of Harris Hill Road from “P” Public and Institutional District to “LI” Light Industrial District, or, subject to consent of the owner, another less intense zoning district classification; including procedural provisions; and providing an effective date; and consider approval of Ordinance 2022-78, on the first of two readings.

Why was this land zoned public, and how did it come into the possession of a private developer?

Can staff elaborate on the "Impervious cover inaccuracies" identified in the "ENVIRONMENT & RESOURCE PROTECTION – Water Quality Model Results" section?

Please provide the names of the PZC commissioners present who did vote for it. Two years from now, we won't remember who was on the PZC. It's in the detail so please repeat in the ARF.
Will the "cut-out" runway protection zone easement stay zoned P?
Why is it granted to Hays County (page 725)?
Should we get that changed?

Why was this land zoned public, and how did it come into the possession of a private developer?
Zoning ordinance information is not readily available for this parcel, staff would have to research ordinances from the 80’s as this area was annexed in 1980.

Hays County sales history online indicates John Spooner (et al.) purchased the property in 1992, but no prior owner is mentioned. The property is still owned by a Spooner and the current applicant will be purchasing the property


Can staff elaborate on the "Impervious cover inaccuracies" identified in the "ENVIRONMENT & RESOURCE PROTECTION – Water Quality Model Results" section? In 2013 when the model was created there was not detailed data readily available so the Comp Plan consultant used national level data from the US EPA – this is not uncommon – especially when the watershed had (has) relatively little impervious cover (it was/is mostly undeveloped floodplain and farmland)

Apologies for the oversight – Sambrano & Costilla were absent. Spell, Kelsey, Agnew, Garber, Meeks, Case & Mendoza were present and the approval vote was unanimous.

Will the "cut-out" runway protection zone easement stay zoned P? Yes

Why is it granted to Hays County (page 725)? That statement came from the applicant. Upon further review of the easement documents it appears the City was granted the right to use the area.
