Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2021-62, amending the official zoning map of the City in Case No. ZC-21-11 by rezoning approximately 0.98 acres of land, more or less, out of lot 5, block 1, San Marcos Business Park, Section 2, located at 1909 Dutton Drive, from “GC” General Commercial District to “CD-4” Character District-4, or subject to consent of the owner, another less intense zoning district classification; including procedural provisions; and providing an effective date; and consider approval of Ordinance 2021-62, on the first of two readings.

1. Since we’ve been asked by the Parks Board to review and update our parkland fee in lieu of requirements, can we hold off on approval of that one piece of their proposal until such time as CC has reviewed and updated the fee in lieu of – could we possibly have the work session re: fee in lieu before the 2nd reading?
2. "Phase 1 approved in 2019 for 11 units" – units of what, spec buildings/offices or homes? Have they been built yet or are they still in the planning phase?

  • In addition to work session re: fee in lieu, Council would need to take action separately on an increase to the fee in lieu. Any delay of more than 90 days on the second reading would result in the need to hold another public hearing on this request. The fee for this development would be assessed with the site permit, an administrative approval, so there would not be another way to delay the project.
  • The entire development is a townhome-type condominium project. The applicant provided a presentation which shows Phase 1 & Phase 2. Phase 1 is under construction at this time. The applicant provided photos of the units under construction. The applicant’s presentation begins on pg. 755 of the packet.
