Consider approval of Ordinance 2021-48, on the first of two readings, amending Chapter 22, Cemeteries, of the San Marcos City Code by, among other things, eliminating the issuance of a recorded deed as the instrument granting a right of interment at the cemetery, removing the reference of a specific city department responsible for cemetery matters, adopting a fee schedule related to the use and operation of the cemetery; providing for the repeal of any conflicting provisions; and providing an effective date.

Will this ordinance ensure the gradual increase in costs past 2031, or will the sitting CC at that time have this brought back to them a year in advance with recommendations from the Cemetery Commission regarding possible increases in the costs associated for the city maintain the cemetery and/or deem the increases sufficient for the next 10 years?

This specific Ordinance is setting the fees up to 2031, but fees can be adjusted at any time. Fees are recommended by the Cemetery Commission to the City Council for consideration. Cemetery Fees will come back to Council within the next year, more or less, to formally set the fees for the lots in the new section of the cemetery, new columbarium and new ossuary. Staff assists the Cemetery Commission by providing projected maintenance and operation costs in an effort to cost recover the cost of the cemetery maintenance contract.
