Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2021-79, amending the Official Zoning Map of the City in Case No. ZC-21-12
by rezoning approximately 363.72 acres of land, generally located between Harris Hill Road and future FM 110 north of Harris Hill Road, from “FD” Future Development to “CD-3”
Character District-3, or, subject to consent of the owner, another less intense zoning district classification; including procedural provisions; and providing an effective date, and
consider approval of Ordinance 2021-79, on the first of two readings.

1. The majority of the site is located within the Lower San Marcos River subwatershed. This area is very rural with agriculture as the dominant land use. At the time of modelling, the source data used for the Lower San Marcos subwatershed was taken from national level, low resolution datasets and therefore the city’s impervious cover and agricultural values may not be accurate. Please explain?
2. concerns with the floodplain/ drainage in the southern part of the site between the bypass channel and the road were indicated by P&Z commissioner Spell, does staff have any information regarding this issue?
I'm not sure what rezoning this question belongs with as we have several for the development agreement.

1. The majority of the site is located within the Lower San Marcos River subwatershed. This area is very rural with agriculture as the dominant land use. At the time of modelling, the source data used for the Lower San Marcos subwatershed was taken from national level, low resolution datasets and therefore the city’s impervious cover and agricultural values may not be accurate. Please explain? This information was taken from the Water Quality Modelling Report in the appendices for the Vision San Marcos Comprehensive Plan in 2013. The developer asked that we note: the Developer is constructing master drainage which will collect stormwater not currently being detained by the adjacent neighborhood, at the Developer's cost. Furthermore, we are working with the City to provide land for the City's construction of master drainage for the Blanco River backflow, which will in turn significantly improve drainage / flooding in the area. The land is being dedicated by the Developer at no cost for the benefit of the community.
2. concerns with the floodplain/ drainage in the southern part of the site between the bypass channel and the road were indicated by P&Z commissioner Spell, does staff have any information regarding this issue? The applicant has not provided detailed plans for the southern part of the site at this stage, however per correspondence from the applicant’s engineers the developer plans to reclaim areas surrounding the effective floodplain through the Letter of Map Revision/ Conditional letter of Map Revision with FEMA. Any development will need to comply with the City’s regulations concerning drainage – a Watershed Protection Plan 2 will be required per Chapter 2, Article 6 of our Land Development Code and all development will need to comply with the City’s Flood Damage Prevention Ordinance.
I'm not sure what rezoning this question belongs with as we have several for the development agreement. All Whisper South zoning requests are in line with the approved PID Term Sheet (May, 2021) and Development Agreement (July, 2021).
