Consider approval of Ordinance 2021-25, on the first of three readings, granting to Maxwell Special Utility District, formerly Maxwell Water Supply Corporation, the right, privilege and franchise to construct, install, extend, remove, replace, abandon, operate and maintain its facilities within the Public Rights-of-Way of the City of San Marcos, Texas for the transportation, delivery, sale and distribution of potable water; containing other provisions relating to the foregoing subject; providing for severability; including procedural provisions; providing for approval on three readings of the ordinance; and providing an effective date.

What happens after 5 years?
No more fees?
Opportunity to renegotiate fees?
Why is it required to send every communication to the Mayor with a copy to the City Manager? Why not just the City Manager?
Do we have a copy of the Maxwell SUD Director's acceptance yet?

After a period of five years, the agreement will be renegotiated.
State statute currently limits up to a 2% fee.
Our communication process was patterned after the Si gas agreement, but the City Manager can be the primary point of contact moving forward.
The Maxwell SUD General Manager indicated that the agreement was approved at their last board meeting.
