Consider approval of Resolution 2024-222R, awarding an Indefinite Delivery Indefinite Quantity (IDIQ) Master Contract to Holbrook Asphalt Co., through an Interlocal Cooperative Purchasing Agreement with the City of Hurst, for the provision of high density mineral bond pavement seal for street maintenance in an annual amount not to exceed $400,000.00, with up to four one-year renewals; authorizing the City Manager, or her designee, to execute the contract and renewals on behalf of the city; and declaring an effective date.

Have we used this vendor before?
What happens if we decide not to continue with this vendor after their first job with us? Are we obligated to pay out the contract? (Assuming no, but want to confirm)

You will recall the mess that a contractor caused on our streets a number of years ago...

The City has not used Holbrook Asphalt Co. previously. But, the City has inspected the work successfully completed in Buda.


What happens if we decide not to continue with this vendor after their first job with us? Are we obligated to pay out the contract? (Assuming no, but want to confirm)

The contract is an IDIQ contract which is a work order contract. The City is only obligated to pay for approved work orders. If the City is not satisfied with the first job, the City is not obligated to proceed with any future work orders.

I believe you are referring to work performed by a former slurry seal contractor. The contract with that contractor was terminated for poor performance.
