Consider approval of Resolution 2022-35R, confirming the City Manager’s appointment of Wayman Mullins to the San Marcos Civil Service Commission; and declaring an effective date.

Previously I asked about the duties of this commission and this was indicated as part of the response "...the primary role of the Commission is hearing promotional exam appeals, adopting rules of the commission and overseeing officer fitness for duty questions, this isn’t watchdog or advocate role. "

For one, this should be included on the City's website as currently it isn't clear who is on this board, or what their duties entail...
Secondly, did this committee meet as it relates to Officer Ryan Hartman, or the shooting of Rescue Eram? If they did not, please explain why. Can this committee request to meet to discuss current issues and do they have more access to police records?

This commission is already included on our website in the Boards and Commissions area including the list of members by name and their terms.
The Civil Service Commission has not played a role in the disciplinary proceedings involving Ryan Hartman. Mr. Hartman could have appealed his indefinite suspension to this commission or to an independent third party hearing examiner. He chose the second route and that appeal process is in progress. The Civil Service Commission did not play a role in the investigation or review of the use of force against Mr. Eram. Since employee discipline was not called for in that instance, they did not have a role to play. Chapter 143 of the Local Government Code specifies that the commission may conduct investigations but only on matters relating to the enforcement and effect of Chapter 143. Those things are issues surrounding things like promotions, demotions and in some cases disciplinary appeals.
