Consider approval of Resolution 2022-155R, authorizing a Change in Service to the agreement with Bowman Consulting Services, Ltd, to provide for final design, bidding and construction administration phase professional engineering services for the West Purgatory Creek Wastewater Improvements project in an additional amount not exceeding $49,940.00 for a total estimated contract amount of $90,580.00; authorizing the City Manager or her designee to execute the appropriate documents to implement the Change in Service on behalf of the City; and declaring an effective date.

The La Cima developer was responsible for the original design of the project. During the 90% design phase it was decided to add a storm sewer outfall associated with the Bishop Street Drainage project and to realign the wastewater line so that only one area would be disturbed at one time and minimize the amount of easements required within a lot owned by Hays County Emergency Services Division. This ACIS#5 is for the remaining design/easement effort as well as bidding and construction phase services and broken down as follows:
  1. Additional Design and Permitting Services, $8,250
  2. Easement Documents, $1,750
  3. Bidding Phase Services, $7,735
  4. Construction Administration, $32,205
Originally easements were going to be dedicated by plat during the Hays ESD development process. The Hays ESD project was then put on hold due to financial challenges requiring easement dedication by separate instrument. The original design contract as well as all ACIS’s 1 through 4 were also associated with the change in wastewater alignment and associated easement documents. Total prior design and easement effort is $40,640 and broken down as follows:

Original Design Contract, $31,340 (Design, Permitting, Meetings)

ACIS #1, $1,300, (Additional topo survey required for redesign)

ACIS #2, $1,750 (Survey Metes and Bounds for Hays ESD Easement)

ACIS #3, $1,750 (Survey Metes and Bounds for Hays County Easement)

ACIS #4, $4,500, (Topo Survey and Metes and Bounds for existing wastewater line abandonment)

Total redesign and easement effort to date including this ACIS#5 is $50,640.

The existing 12-inch wastewater line was identified in the Wastewater Master Plan to be upsized based on future growth and the wastewater flows associated with it. At the outset of the La Cima development their generation of wastewater flows was assessed through the City’s existing system. Based on their impacts they replaced lines along Craddock and made improvements to the Franklin Lift Station. Additionally, this 12-inch line was identified for replacement. La Cima’s cost sharing responsibility for this project was determined to be the design for the replacement of this line. As negotiated with La Cima, the City would then construct the project providing an 18-inch wastewater line providing system capacity for the entire sewershed in accordance with the Wastewater Master Plan.
