Can we establish requirements for lighting in line with Bird City Texas Requirements? The San Marcos Development Code is dark skies compliant, which is one of the Bird City Texas Criteria
Why would we not restrict the hours of operation allowed? Hours of operation are not typically restricted by the Development Code – the only Code restrictions are where a use is considered Limited and the proposal is to make this a by-right use
Were there any concerns from Police or Fire about the internal road sizes and responding to inevitable calls to this location? Not at this time. Fire Marshall’s office will also review the site plan for compliance before any construction is approved.
What is the estimated Tax value for this use as compared to other community commercial options? This is something we will have to look into – we will try to have an answer at tomorrow’s meeting
Could we require that buildings under this designation be required to meet certain sustainability thresholds such as materials longevity, energy/water conservation, tree relocation, etc.? City Council may propose amendments to what is presented. As currently presented, the buildings must be 80% brick, stone, stucco, concrete, or faux stone/brick and the development will have to comply with tree mitigation required by code. They are also subject to the newer water quality requirements.
What happened to the sidewalk? Sidewalks are required per Exhibit D. #3.H – they will have to build sidewalks or pay fee-in-lieu, which are the two options they have in the Code as well.
Where is the redline version of the agreement? There appears to be two documents, neither is redlined. There is yellow for text that appears to be added on both. Correct, since the ‘redlines’ were so minor staff presented the additions with highlighting as a way to draw attention.
