Receive a staff presentation and hold a public hearing to receive comments for or against Ordinance 2022-19, amending the Official Zoning Map of the City in Case ZC-22-05, by
rezoning approximately 55.344 acres of land generally located approximately 280 feet northwest of the intersection of Posey Road and South Old Bastrop Highway from “FD” Future Development District to “CD-3” Character District - 3, or, subject to the consent of the owner, another less intense zoning district classification, including procedural provisions; providing an effective date, and consider approval of Ordinance 2022-19 on
the first of two readings.

Three commissioners voted against this and eight of them expressed concern about a buffer next to the adjacent cemetery including the possibility that there may be graves outside the bounds of the cemetery. Sam Aguirre agreed that this information should be provided to Council.

PADS has been so good at including the significant notations by PZC for the last few months which has been very helpful. Please advise where those notes are because I can't find them for this item.

Staff would not have information on where the grave sites are. The summary of the discussion was included in the staff report. Upon further investigation it appears the staff report may not have made it into the packet (we will look into why). It is attached here and the summary can be found on pg. 2. I believe P&Z was suggesting City Council “buffer” the cemetery by reducing the limits of the proposed zoning on that side of the subject property. This was done fairly recently with a CD-5 request adjacent to homes in the ETJ.
