Item 17: Tanger Outlet Agreement

Consider approval of Resolution 2022-145R, authorizing a restated agreement with Tanger Properties Limited Partnership to lower the annual not to exceed amount to $50,000.00 to fund a joint advertising program and authorizing four additional one-year contract renewals; authorizing the City Manager or her designee to execute the restated agreement on behalf of the City; and declaring an effective date.

I see 4 renewals as part of this contract. Will each renewal come before council for approval each year?

I see that the agreement has changed considerably, perhaps because proof of compliance was requested last time and although Tanger provided proof of the ads, etc. proof of compliance with the agreement was not. And the surveys are no longer required.

Since part of the activity now is promoting activities on Tanger digital message boards, what will be the proof of that? I see that our staff will provide content but that doesn't guarantee it will be displayed.
Information on the social media platforms can be captured and reported.

I'm not sure why the required activities are under the "5. Reports" section. Shouldn't it be under "4. Advertising Placement; Program Costs; Payments." or better yet, a new section entitled "Tanger Responsibilities?"

And then define the proof needed under "5. Reports"
