Receive a Staff presentation and hold a Public Hearing to receive comments for or against Resolution 2023-135R, approving a request by LJA Engineering on behalf of Onx-High Branch, LLC, assigned Case No. AC-23-04 (The Ridge at High Branch Phase 2 and 3), for an alternative compliance to the maximum cut and fill in Section 6.1.2.2 of the Land Development Code for a proposed residential subdivision generally located near Redwood Road between State Highway 123 and Old Bastrop Highway; authorizing City staff to issue permits consistent with this Resolution; and declaring an effective date; and consider approval of Resolution 2023-135R.

Since Planning and Zoning Commission voted to deny 7-0, should City Council choose to approve, how many votes are required?

Please be ready to provide details of the city project at Hills of Hays that is underway and how it relates to this request.

A regular majority of 4 Council members is required.

Staff will provide details during the presentation about how the Development and the City’s Hills of Hays project are related. The Developer has agreed to convey additional flows through their site as part of their project. If their project does not go forward, the City project will need to design and construct an alternative storm system to convey these additional flows around or through the Hills of Hays subdivision using City stormwater funds.
