Receive a Staff presentation and hold a Public Hearing to receive comments for or against Resolution 2021-246R, approving a Development Agreement with HK Baugh Ranch, LLC, HK Riley’s Pointe, LLC, and Benchmark Acquisitions, LLC, to regulate the annexation and future development of approximately 1,142 acres of land presently in the City’s Extraterritorial Jurisdiction and generally located along Old Bastrop Highway between Redwood Road on the Southwest and the San Marcos River on the Northeast; authorizing the City Manager, or his designee, to execute the agreement on behalf of the City; and providing an effective date; and consider approval of Resolution 2021-246R.

In the ARF, in "The City waives the 505 minimum parkland dedication and the HOA will maintain private parks" what is "505" referencing?
Is Riley's Pointe identified on any of the maps?
Page 12 of the agreement shows
"(c) The City agrees that the City Manager shall, upon request from the District, issue a letter of assurance to the owner of the platted property within the District confirming water and wastewater availability for the platted property." Can we do that where Crystal Clear will be the water provider?

Response to Mayor, provided by Tyler Hjorth, Director of Utilities:
1. 505 is a typo. This should read: "The City waived the 50% minimum parkland dedication."
2. The Riley’s Pointe Concept Plan slide was not included in the original packet. We have since updated the PDF and included online and in the presentation.
3. The Developer Agreement states such, but the corresponding Consent and Utility Agreements for Riverbend (which is in CCSUD’s water CCN) include language that carves out the water piece. Please note that the City is capable and willing to provide water services as well, should CCSUD be unable to do so or if Riverbend chooses to opt out of their CCN.
