Receive a staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2022-31, annexing into the City approximately 74.24 acres of land within the La Cima Development and generally located at the west corner of the Central Park Loop and Fountain Grass Drive intersection in Case No. AN-22-06; including procedural provisions; and providing an effective date; and consider approval of Ordinance 2021-31, on the first of two readings.

Why are the risk assessment civil service response times not included?

Given that this is part of a development agreement, would we be able to remove the occupancy restrictions for their requested zoning category?

Why are the risk assessment civil service response times not included? This was simply an oversight – the map is attached. The map has been added to staff’s checklist of items that should be included in the packet for Annexation and Zoning.

Given that this is part of a development agreement, would we be able to remove the occupancy restrictions for their requested zoning category? This item is specifically for annexation, however there are associated zoning changes on the agenda as well. Is it possible to approve zoning but remove occupancy at this time – no, it is not possible to ‘condition’ zoning or remove / add standards to the district at the time of zoning. If council is to consider removing occupancy restrictions it would need to be considered as part of a development agreement amendment. Staff is currently processing an amendment to this development agreement which should be before the full Council in May or June – at that time this proposal could be considered.
