Consider approval of Resolution 2021-124R, approving an agreement with the Estate of Myrtle McCarty Estate providing for the City to purchase approximately 10.492 acres of land in the vicinity East of the intersection of San Antonio and Olive Streets, together with a drainage, water and wastewater easement across 0.251 acres and a temporary workspace license across 0.41 acres, for a price of $100,000.00, together with associated closing costs, in connection with the Purgatory Creek 18-inch Wastewater Main, Bishop and Belvin improvements and Purgatory Creek Phase 2 improvements projects; authorizing the City Manager, or his designee, to execute said agreement; and declaring an effective date.

The easements can only be used for the specified utility maintenance/ replacement. The approx. 10.5 acres that is being purchased will be owned fee simple by the City. It is within the floodway of Purgatory Creek and can be used for trails, water quality, flood capacity, etc, as the City sees fit.
