Consider an appeal by Troy Turner of the decision of the Planning and Zoning Commission on March 8, 2022 to deny a request for Alternative Compliance (AC-22-01) to the protective yard installation requirements in Section 7.2.2.4 of the Development Code for a proposed development located at 312 Camacho Street.

Have we heard back from the applicant and the neighborhood about their scheduled meeting?

The neighborhood meeting was not held by the applicant. The applicant has submitted a withdraw letter for this item and Mayor Hughson will make an announcement before we begin the Citizen Comment portion of the Council meeting.

Legally, where are we on the calendar as to any deadlines? Yes, Code (Section 2.8.1.3) requires a decision on the appeal within 30 working days of the close of the public hearing
What if we decided to postpone again? What would be the issues, if any, in timing? The public hearing was held on 4/19/22. A decision on this item must be made by 6/1/22. Additionally, the applicant has submitted a withdraw letter for this item. City Council may accept this withdraw and no discussion or action is necessary.
