Consider approval, by motion, authorizing negotiations with Franklin Mountain San Marcos I, LP to amend the (SMART Terminal) Chapter 380 Economic Development Incentive and ETJ Development Agreement previously approved by City Council to among other things, remove references to the incentive for the Katerra project and include acreage previously approved under the Cotton Center Development Agreement, and consider the
appointment of a Council Committee to review the aforementioned Development Agreement, if desired.

What can you tell us about the new applicant, it seems to be hard to find anything about Franklin Mountain business. It looks like they are a recent branch of some larger group, can we find out who they are a subsidiary of? Will they have a spokesperson there to answer our questions?

What's the emergency response time to this location?

What can you tell us about the new applicant, it seems to be hard to find anything about Franklin Mountain business. It looks like they are a recent branch of some larger group, can we find out who they are a subsidiary of? Will they have a spokesperson there to answer our questions? A spokesperson is not planning to be on this evening as this is just initial authorization and establishing a Council Committee, if desired.

What's the emergency response time to this location? Fire station map is attached.

There was not a restrictive covenant for this property. The attached is an excerpt from the original development agreement. The applicant is reviewing this list to determine if they want to make any changes.
